The Process…..
Free consultation
We will answer all the questions going through your mind; what is an executor, who can be a benenficiary, what happens if my sopuse re-marries after I’m gone, what happens to my children, where does all my money go, do I have to pay inheritance tax and so on. With over 20 years industry experience there isn’t much we haven’t seen or had to deal with.
Instruction taking
We will take your instructions, guiding you through the process as we go. There may be some questions you do not know the answer to but that’s ok, we send you draft documents to give you time to find out any details you don’t know immediately. Once we have taken your instructions we will ask for payment. Once payment has been received we will send you your draft documents for approval along with a welcome pack with lots more information on Wills, Trusts, Powers of Attorney, Inheritance Tax and what to do should the worst happen.
Final documents
Once approved we will send you your final documents for signing (and witnessing) with full instructions on how to do so. Once signed and witnessed (correctly) your documents are legally valid. You can choose to keep them yourself or we can store them for you. We will contact you periodically to see if you need to update your Will. It really is as simple as that. A lot less daunting than many people think and once you’ve done it, thats’s one less thing on your “I’ve been meaning to do that” list.
John and Jane Smith. Married homeowners with 2 young children.
Jane dies unexpectedly leaving John to bring up the children on his own. They own a house together and have a little saved in the bank for a rainy day. Sometime after Jane’s death, John meets Sally and they get married. Many years later John dies leaving everything to Sally and the children from the original relationship are left with nothing. This is all too common and is easily solved.
Mirror Wills with a standard property trust would have prevented all the assets passing to the new wife (or husband), ensuring Jane’s children receive their inheritance.
Cost to set-up £500
Example scenario’s and solutions……..
Amanda. Divorced and taking care of her children. Ex-husband David is good dad but terrible with money.
Amanda dies and custody of the children (automatically) goes to David. He is now responsible for their day-to-day care and upbringing. Amanda didn’t have a Will but all her assets pass to the children. As David is now the only parent, he has sole responsibility for the children and their finances. He has to reduce his working hours to take care of the children and soon the inheritance Amanda intended for her children is all gone
A Single Will with a simple children’s trust would ensure the children’s inheritence is protected
Cost to set-up £295
Linda and Michael James. Married homeowners with 3 grown-up children & 6 grandchildren
Linda and Michael want to be sure that their home and savings pass to their children and grandchildren when they die. They are concerned about the rise in dementia cases and potential future care-home fees. They are also worried that one of their children recently went through bankruptcy after his business closed.
Linda and Michael certainly need Mirror Wills and Lasting Power of Attorney documents. They could choose option one, a standard property trust protecting half the assets or option two a lifetime trust protecting assets up to £650,000.
Cost to set-up option one - £1100*
Cost to set up option two - £2995*
*plus disbursments and OPG fees
